1. Introduction

These Terms and Conditions ("T&C") constitute an electronic record in accordance with the Information Technology (Intermediaries Guidelines) Rules, 2011, under the Information Technology Act, 2000, and other applicable provisions. No physical or digital signature is required for this electronic contract. The T&C herein govern your ("You", "Your", "User") use of the turia website, mobile application, services, features, and content made available by Astroturia Technologies Private Limited ("turia", "We", "Us", "Our"), including any extensions or connected media ("Platform").

By clicking "I AGREE" or by availing any service or accessing the Platform, you acknowledge and accept these T&C. If you disagree, you must refrain from using the Platform or Services.

2. Acceptance of Terms, Modification & Notification

You must (i) be at least 18 years of age and competent to contract under the Indian Contract Act, 1872, (ii) register using your real and accurate details, and (iii) not currently be restricted from using our Services.

By continued use of Services, you agree to the latest T&C and related policies as published on the Platform. turia reserves the right to amend, modify, or update these T&C at any time, at its sole discretion. Such changes become effective upon being published on the Platform or notified otherwise; your continued use constitutes acceptance.

You may terminate your Account by written request if you do not agree to any updated terms.

3. Description of Services

Our Services include, but are not limited to, astrological readings, daily predictions, consultations, numerology, and related content, delivered through a combination of AI-powered astrologers and human astrology contractors engaged by turia.

Services are provided for informational, spiritual, and entertainment purposes only. turia does not offer medical, psychological, legal, or professional advice. Users must consult relevant professionals for such matters.

turia disclaims all liability for any actions you take as a result of interpretations, predictions, or advice provided. You assume full responsibility for use of Services.

4. User Registration, Account, and Eligibility

To access paid or personalized services, Users must register and create an account. One account per User is permitted, under your real name.

You are responsible for safeguarding your credentials and must notify turia immediately in case of unauthorized use.

turia may suspend or terminate accounts for untrue, inaccurate, or incomplete registrations or for breach of any term.

5. Representations and Warranties by Users

By using the Platform, you represent and warrant that:

• You are legally competent and agree to be bound by these T&C.
• All information provided is accurate and true.
• The use is lawful and does not violate any applicable law or third-party rights.
• You will not use the Platform for unauthorized, commercial, or prohibited purposes.

6. User Content

You are solely responsible for any content you post or submit to the Platform ("User Content"). You represent and warrant that you own all rights to your User Content or have obtained all necessary licenses and consents to provide the User Content to the Platform. You grant turia a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the Platform. You agree not to use the Platform for any unlawful or prohibited activity, including attempting to purchase turia services for business purposes.

7. Services Fee & Payment

Paid Services are made available through (i) a prepaid wallet used for chat consultations, and (ii) one-time payment for individual reports.

Payments are processed via authorized payment gateways; you represent and warrant that you are authorized to use any payment method you submit.

Refund Policy: Refunds are provided only where a payment has been deducted and the corresponding Service (chat consultation or report) was not delivered due to a verified technical or platform-side failure. Refunds are not provided for connectivity or device issues on the User's end, unused wallet balance, or dissatisfaction with the content, accuracy, or outcome of any prediction, interpretation, or report. turia is not responsible for any payment-related issues arising from third-party providers.

8. Availability of Services

turia reserves the right to modify, suspend, restrict, or discontinue any part of the Platform or Services at any time without notice or liability.

Certain Services may be unavailable in your jurisdiction or due to technical faults.

9. Intellectual Property Rights

All content, software, databases, graphics, text, designs, and trademarks ("Content", "Marks") on the Platform are proprietary to turia or its licensors and are protected by copyright and other intellectual property laws.

Users are granted a limited, non-exclusive, non-transferable right to access Services strictly for personal, non-commercial use in accordance with these T&C. This license does not include any resale or commercial use of the Platform or its content; any collection and use of any content listings, descriptions, or prices; any derivative use of the Platform or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Users may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Platform, or reverse-engineer, republish, or otherwise exploit Platform content or data for any commercial, derivative, or AI/data training purposes. Users may not frame or utilize framing techniques to enclose any trademark, logo, or proprietary information of turia, and may not use meta tags or other hidden text utilizing turia's name or trademarks, without express written consent.

10. User Conduct and Prohibited Activities

You agree not to:

• Violate any law, regulation, or third-party rights.
• Post, transmit, or share unlawful, defamatory, harassing, obscene, or infringing content.
• Conduct unauthorized commercial activity or advertisements.
• Attempt unauthorized access, introduce viruses or malicious code, mine data, or interfere with Platform operations.
• Extract Platform content for data scraping, ML/AI model training, or any unauthorized purpose.

11. Monitoring & Platform Management

turia may, at its sole discretion, monitor, restrict, suspend, or terminate any account or content for violations of these T&C or to protect Platform integrity.

12. Use of Information

All information is collected and processed in accordance with the Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of data per our Privacy Policy.

Data may be retained for legal compliance, dispute resolution, and to ensure service quality.

13. Communication Consent

By registering on the Platform, using the Services, making a payment, submitting your phone number, or otherwise interacting with turia, you expressly consent to receive communications from turia through WhatsApp, WhatsApp Business Messages, SMS, phone calls, email, in-app notifications, push notifications, or any other communication medium.

These communications may include, but are not limited to, OTPs, service updates, transaction confirmations, consultation updates, reminders, account-related alerts, wallet or subscription-related updates, product updates, offers, promotions, marketing campaigns, and other information related to your use of the Platform and Services.

You agree that such communications may be sent to the mobile number, WhatsApp account, or email address provided by you, even if such number is registered under any Do-Not-Disturb or similar registry, to the extent permitted under applicable law.

You may opt out of promotional or marketing communications where such opt-out facility is provided. However, turia may continue to send transactional, service-related, account-related, payment-related, security-related, or legally required communications.

14. Third-Party Integrations and Links

The Platform may contain integrations or links to third-party sites/products. turia is not responsible for such external content or services.

15. Limitation of Liability & Disclaimer

The Platform and Services are provided "as is" and "as available," without warranties of any kind. turia makes no representations or warranties of any kind, express or implied, as to the operation of the Platform, or the information, content, materials, or Services included on or made available through the Platform. You expressly agree that your use of the Platform is at your sole risk.

To the fullest extent permissible under applicable law, turia disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. turia is not responsible for the accuracy, reliability, or outcomes of predictions, advice, or recommendations and is not liable for damages, losses, or injury resulting from use of the Platform, including direct, indirect, incidental, punitive, and consequential damages.

Astrologer Services Disclaimer: The astrologers made available on the Platform include both human contractors engaged by turia and AI-powered virtual astrology personas, neither of which are employees or agents of turia acting in a professional advisory capacity. turia does not guarantee the accuracy, completeness, or usefulness of any information provided through the Platform. Any advice, guidance, or recommendations provided are solely for informational and entertainment purposes and should not be construed as professional advice. You acknowledge that use of the Platform is for entertainment purposes only and should not be considered a substitute for professional advice. The Services offered are strictly not meant to replace any philosophical, emotional, or medical treatment.

16. Indemnification

Users agree to indemnify turia, its partners, employees, and affiliates against all damages, losses, and expenses arising from:

• User's breach of these T&C or Policies.
• Violation of applicable laws or third-party rights.
• Misuse or unauthorized use of Services.

17. Termination

turia may terminate or suspend your account, without notice or refund, for breach of these T&C, Privacy Policy, or applicable laws.

You may terminate your account via written request.

In case of termination, remaining wallet balance may be forfeited upon voluntary account deletion. Users should use their balance before deletion.

18. Dispute Resolution, Governing Law & Jurisdiction

These T&C shall be governed by the laws of India. Courts in New Delhi, India shall have exclusive jurisdiction over any disputes arising out of or relating to these T&C or your use of the Platform.

19. Miscellaneous

If any provision is held invalid, the remainder of the T&C shall continue in force.

These T&C constitute the full agreement between User and turia; no joint venture or employment is created.

Users may not assign rights or obligations without prior written consent; turia may assign to affiliates or successors.
